How to Understand and Resolve
Technical Issues of Election Irregularities

I.                   CONTEXT Summary

A.    National Election Commission (NEC) is completely, indisputably biased to the ruling Cambodian People’s Party (CPP); many demands for reform of NEC over the years have gone unheeded by the ruling CPP.

B.    CPP claims victory of 68 seats to Cambodian National Rescue Party’s 55; CNRP claims victory of 63 seats to CPP’s 60 seats; NEC announced preliminary results, prior to resolving the mounting criticism of election fraud and irregularities, aligned with CPP’s claim.

C. NDI Cambodia’s Voter Registry Audit, 2013; Human Rights Watch Ruling Party Orchestrated Vote Fraud; Editorial "Cambodia's Tipping Point" and article Giving More Than 100%  in The Phnom Penh Post.  CNRP Seminar on Resolutions to Technical Issues (18 Aug. 2013)

D.   NEC conducted a “review and compare” process (rather than a proper hearing) in response to complaints filed by CNRP for 15 provinces of which the NEC baselessly dismissed all except for 4 provinces:
-          15 August 2013: Kratie Province
-          16 August 2013: Kandal, Siem Reap, Battambang Provinces

Article 16 of the Electoral Law requires a proper public hearing, comprising of the top nine members of the NEC to be present and for the filing Party to have adequate time adequately to present their case.  What took place on Aug. 15 and 16 was a mere cross-checking of records.

On both dates, the NEC summarily rejected the request of the CNRP to review the original documents sealed in the “Security Bag A”, dismissively stating that the irregularities do not arise to level of “grave irregularities, impacting the election results [seat allocation]” (para. 8.28.1.2 of the NEC Internal Rules) – an arbitrary judgment that runs contrary to public sentiment and mounds of evidence.

E.     Seat allocation is not based on a fixed number of votes obtained for all 24 provinces.  Rather, seat allocation is based on a multi-step formula using the law of average particular to each province.  It factors in:

-          Ballots cast considered VALID
-          Ballots cast considered VOID
-          Figure of seat allocation for that particular province, (e.g. Siem Reap has 6 seats; Kampong Cham, 18; Kandal, 11)  

For example (as explained by a senior CNRP official to CIVICUS Cambodia), in Siem Reap, let’s say, hypothetically:

-          300,000 VALID ballots cast [total votes cast minus void ballots] 
-          CPP = 160,000
-          CNRP = 120,000

STEP ONE:  total votes cast minus void ballots divided by total seat for that province equals the “quota”.  (The quota is the number of votes a party must receive in order to get one N.A. seat for that particular province.)

Five (5) seats have been allocated of the total possible 6; one seat remains.  The formula to get this remaining seat is:

STEP THREE:                     CPP = 40,000              CNRP = 40,000

In this case of a tie, the seat is determined by the casting of a die (lottery).

However, if the CPP had received a total valid votes of 160,001 (rather than 160,000), this remaining 6th seat would have gone to the CPP based on the Step Three formula. 

Effectively, in this hypothetical, the CPP would have received one National Assembly seat based ONLY on one extra valid ballot!  Herein lies the heart of CNRP’s contention!  The devil IS really in the details!

F.   For example, in Kandal Province, CNRP claims it needed only 168 more votes for another N.A. seat.  The CNRP is asking for a re-vote for Polling Station No. 1204 at Sa-ang Phnom commune/khum in Sa-ang district/srok, which was forcibly, prematurely and unduly closed just after 9:00 am on Voting Day, July 28, 2013 (legal and normal closing time: 3:00 pm).

Only 80 citizens were able to cast their ballots while over 600 were registered as voters at that polling station. Because for the whole Kandal province/khet the discrepancy in figures for the CNRP to be allocated an extra National Assembly seat is razor-thin, only 168 votes on a total of 648,737 ballots casted ( 0.00025%), a re-vote is fully justified.

II.                PRINCIPLE at the heart of the matter

Integrity of the Votes.  The right to vote is a fundamental right enshrined in the basic international documents as well as each country’s Constitution.  It is basic to democracy, oftentimes the main measuring criterion.  Implicit in this right to vote is that the integrity of the vote is ensured.  

We must protect the will of the Cambodian people, who against all odds (of fear and intimidation, an unlevel playing field) courageously voted their conscience.  The reasons to protect the integrity of the votes (the people’s voices and aspirations) should not—though easily can—be drowned out by the political brinkmanship and bickering and the mentality of resignation, “Well, this is Cambodia.”  

The process is expensive in terms of money and emotional energy.  But the process is most costly to the lives of the Cambodian people.


III.             POLITICAL ISSUES to Irregularities

A.    National Democratic Institute  Cambodia’s Voter Registry Audit, 2013
-         Fifteen per cent of voters – about 1.2 to 1.3 million of 9.6 million registered voters– unable to vote because of list irregularities;

-          Approx. 1 million ghost names on the voter list;

-          Approx. 200,000 duplicate names.

B.     Human Rights Watch

IV.             TECHNICAL ISSUES to Irregularities (mainly, voting day/vote tabulation)

A.    ID Cards

NDI found that at 60 percent of polling stations, citizens with adequate, valid documentation were turned away. And in a quarter of the polling stations, people were allowed to vote without a valid ID (Cambodian Opposition Rejects Election Results The New York Times, 29 July 2013)

B.     Problems of Discrepancies in Forms 1102, 1104, 1108

Form 1102

-          Original copy in Security Bag A for that polling station
-          Issues: 
1.      Both CNRP and election monitors claim discrepancies between their copies of form 1102 with the one used by NEC/PEC/SEC.
2.      Comfrel notices certain 1102 forms erased with “white-out”

-          This form is filled out by the polling station official
-          Issues: 
1.      Both CNRP and election monitors raised the gross irregularity of seeing 1104 forms used by NEC for 13 voting booths with the exact same handwriting, an impossibility as each 1104 is the unique report of each voting booth on voting day.

2.      The figures for votes cast are recorded for the 3 major parties (CPP, CNRP, Funcinpec), but no figures of votes cast are given for the smaller parties. 

-          Implications:
1.      discrepancy between total votes cast for each party as recorded and the actual total votes cast;

2.      leaving room for fraud in changing “void” ballots to “valid” votes for small parties with no seat, affecting the QUOTA figure, and consequently impacting on seat allocation.

Form 1108 – summary of everything for each voting booth: the figures of ballots cast, ballots void, registered number of voters for that booth, etc.  

-          Very difficult to alter
-          Original forms are sealed in the Security Bag A,
-          No copies given to monitors or political parties

-       At the NEC process of resolving disputes on 16 Aug. 2013, the NEC cannot produce its own copies of this 1108 form for 8 voting booths in Takmao of Kandal Province; the CNRP claimed (based on a confidential informant) that these forms have been burned and has requested to see the original forms in the Security Bag A.  The NEC refused saying that the situation does not arise to “grave irregularity affecting election result.”

C.    Manipulation of “VOID” Ballots

Direct impact – obviously, ballots incorrectly deemed “void” will decrease the total votes for seat allocation.

Indirect impact in the calculation of seats allocation based on the quota and the law of average.  For example, the incomplete filling out of form 1104 in leaving out figures for votes cast for smaller parties opens up space for fraud in the tampering of numbers by moving “void” ballots in CNRP to smaller parties without any seat as “valid”, which impact on the calculation for QUOTA figure and ultimately seat allocation.

V.                CONCLUSION

The above information is culled from reports of election monitoring organizations, mainly Comfrel and NDI, and of the CNRP, and based on my experience of training political party agents on the election process in the 2002 commune and 2003 national elections as well as having served an international election monitor in the Bangladesh elections, 2008.

This Public Announcement only gives a glimpse, only the tip of the iceberg, into the grave irregularities which form the basis for CNRP’s contestation of the preliminary election results announced by the NEC.  

Each irregularity on its own raises at minimum the high suspicion of fraud, and when the irregularities taken together, they form an invidious, intentional, systematic fraud to deny the people their will and their voices.  

In light of the pervasive grave irregularities, the situation is far from one of just suspicion of and carelessness on the part of the NEC.  It is rather one of grave, gross, and systematic fraud that demand at the very least the unsealing of Security Bag A (inter alia, storing all the original documents) in order to address properly the complaints filed by the CNRP.  

The standard of reasonableness has been breached repeatedly by the NEC in refusing to unseal the Security Bag A.

VI.             RECOMMENDATIONS.  Simply,

A.    At the contested voting booths, unseal the Security Bag A which contains all the original documents, among other items, for each booth. 

B.     And if need be, conduct a re-vote for that particular polling station.

C.     Establish an independent Joint Committee of Inquiry to address the pervasive, grave irregularities.  The composition should not include the NEC which is at the heart of the problem, and must include election monitoring civil society organizations and the UN, if it is to gain the trust of the Cambodian people, the owners of these votes.

CIVICUS Cambodia defines a "citizen" as a Cambodian who possesses both rights and responsibilities, and our focus starts with young children in educating them not only of their inherent rights but of their civic responsibilities to each other.  We also engage with the rest of the population to inform about and encourage them on exercising meaningful citizenship.

Good Work. Good paper. One more thing I don't understand. How do they allocate seat in each province? Is it by number of population? How many vote per seat?
Also I hear about seat substitution. For example Hun Sen's son didn't win, but I heard his party will be able to give him a seat in the parliament because some in his party that got elected give up his seat for Hun Sen's son. How does that work?

In other countries, all you need is one, only one, of these suspicions and criminal investigations will immediately start from top to bottom, no stone unturned. If one, only one, of these turned out to be true, someone or all persons involved will go to jail (Especially, about the burning of the officials papers part), the organization will be disbanded, and the election declared invalid.

Koh Tral Island must not be forgotten

Why do Koh Tral Island, known in Vietnam as Phu Quoc, a sea and land area covering proximately over 30,000 km2 [Note: the actual land size of Koh Tral itself is 574 square kilometres (222 sq miles)] have been lost to Vietnam by whose treaty? Why don’t Cambodia government be transparent and explain to Cambodia army at front line and the whole nation about this? Why don't they include this into education system? Why?

Cambodian armies are fighting at front line for 4.6 km2 on the Thai border and what's about over 30,000km2 of Cambodia to Vietnam. Nobody dare to talk about it! Why? Cambodian armies you are decide the fate of your nation, Cambodian army as well as Cambodian people must rethink about this again and again. Is it fair?

Koh Tral Island, the sea and land area of over 30,000 square kilometres have been lost to Vietnam by the 1979 to 1985 treaties. The Cambodian army at front line as well as all Cambodian people must rethink again about these issues. Are Cambodian army fighting to protect the Cambodia Nation or protecting a very small group that own big lands, big properties or only protecting a small group but disguising as protecting the Khmer nation?

The Cambodian army at front lines suffer under rain, wind, bullets, bombs, lack of foods, lack of nutrition and their families have no health care assistance, no securities after they died but a very small group eat well, sleep well, sleep in first class hotel with air conditioning system with message from young girls, have first class medical care from oversea medical treatments, they are billionaires, millionaires who sell out the country to be rich and make the Cambodian people suffer everyday.

Who signed the treaty 1979-1985 that resulted in the loss over 30,000 km2 of Cambodia??? Why they are not being transparent and brave enough to inform all Cambodians and Cambodian army at front line about these issues? Why don't they include Koh Tral (Koh Tral size is bigger than the whole Phom Phen and bigger than Singapore [Note: Singapore's present land size is 704 km2 (271.8 sq mi)]) with heap of great natural resources, in the Cambodian education system?

Look at Hun Sen's families, relatives and friends- they are billionaires, millionaires. Where did they get the money from when we all just got out of war with empty hands [in 1979]? Hun Sen always say in his speeches that Cambodia had just risen up from the ashes of war, just got up from Year Zero with empty hands and how come they are billionaires, millionaires but 90% of innocent Cambodian people are so poor and struggling with their livelihood every day?

Fleeing to a construction site, Gaddafi and his inner consort hid inside drainage pipes while his bodyguards battled the rebels; in the conflict, Gaddafi suffered head injuries from a grenade blast while defence minister Abu-Bakr Yunis Jabr was killed.[276][278][279]

A Misratan militia took Gaddafi prisoner, beating him and stabbing him in the anus, causing serious injuries; the events were filmed on a cell phone. Pulled onto the front of a pick-up truck, he fell off as it drove away. Who rebutted the above Public Announcement they can be considered as the same thug of
the CPP and NEC we don't to pay attention on that comment, it is just a trash comment.

In fact, only the NEC itself is considered as an irregularity and violate the law already. Because this body was formed by the CPP, it is not independent body. The
majority of its member are the CPP members. This body became slavery
and has been under control of CPP
and served it benefit all along
these years. All these facts have been seen clearly at everybody eyes if they are not blind or deaf.

Is there a such of NEC in any
country in the world ?. Look at in Thailand last general election if its NEC is not independent as Cambodian NEC, Yinlac Shinawatra never won the election and became
the Thai Prime Minister as todate.

Ther would not be this mess if Cambodia had term limit. A maximum of two five-year terms should serve the country better. The national interests and manifestation should be the only living and continuing shrine, not some single, individual bozo, intelligent or crazy one.

People do not have to endure listening to the jokers like Siphann or Ganharit day after day, year after year, to know that their bosses just want only to keep hold of power and control for themselves and their cronies!

VC have tricked Hun and his dynasty just like they did to all of our predecessors e,g divide his own part from Chea Sim to Heng Sarin and so on, and then, made his nation to be a corrupted nation and then, suck up all of our natural resources e,g stealing money from bank, reprint the paper money and tried to buy all real gold from Cambodia, then, exploited its population to get all kinds of donations e.g medicine, foods, clothes, blankets, other building materials, funding etc only to benefit their population under international community's nose. They have fooled them all well, no wonder khmers have nothing left to eat. They control the arm forces to department of health and they decide when where to continue to kill us khmers.

Today, international realised that is all both Viets and Chinese's tricks and is really crossed at them both. This time, you can run but you can't hide because the truth will always be the truth. It is time for the international community to put a stop to them all. All nations muct join hands into one and try to eliminate these shit head out of the world map. US have learnt that khmers armies are Viets in uniform and to train them is like training the croc, and so, they decide to leave it for now. To them, nothing can beat high tech, targeting a direct attack by using the drone, and guided missile to attack a certain group and location. So, it is no good to use communication skills with these animals of the Hun and dynasty.

They are worst than animals. They are very good at lying deceiving and manipulation. It is time to settle with gun and bullets in their heads. So, enough lesson has been learnt from these animals in the human form. Now, they know that these crooks are behiind the killing field, in order to rob their country and their livelihood, what a dicthead!.

Yes, it is time to use sanction and it is time to prob on them, targeting the attack whenever, where ever possible.
