UN 'concerned' over Khmer Rouge judge's legal limbo [-The UN has been sleeping for the past 3 months?]

PHNOM PENH — The United Nations voiced concern Wednesday over Cambodia's delay in appointing a foreign judge to the Khmer Rouge tribunal, paralysing probes into two cases strongly opposed by the government.

Swiss judge Laurent Kasper-Ansermet arrived in Phnom Penh last month as the UN's choice to replace a German judge who abruptly quit in October over government opposition to further prosecutions linked to the 1975-1979 regime.

"The United Nations has since made every effort to secure the appointment of the judge," UN chief Ban Ki-moon's spokesman Martin Nesirky told AFP, adding Cambodia had "an obligation" to appoint the reserve choice in the case of a vacancy.


But the government body charged with rubber-stamping the nomination has failed to meet in recent weeks, leaving the Swiss judge in a legal impasse, in the latest setback to the court.

"The United Nations is concerned that, more than three months after the resignation of the international co-investigating judge, the Supreme Council of the Magistracy has not appointed the reserve international co-investigating judge to replace him," Nesirky said.

The Cambodian justice ministry confirmed that it had received a letter from the UN requesting the council to discuss the matter.

"We don't know when the meeting will take place," cabinet chief Sam Pracheameanith told AFP, declining to elaborate.

Observers from the US-based Open Society Justice Initiative said in a statement that Cambodia was stalling, "effectively leaving the judicial investigations in a state of limbo".

Kasper-Ansermet's Cambodian counterpart You Bunleng on Monday publicly refused to work with the Swiss, who he said was not legally accredited.

Kasper-Ansermet, meanwhile, accused You Bunleng of blocking "important" information about the two new cases involving five ex-Khmer Rouge members accused of crimes against humanity.

The tribunal has so far completed just one trial -- jailing Kaing Guek Eav, a former Khmer Rouge prison chief, for 30 years in July 2010 for overseeing the deaths of 15,000 people under the brutal regime.

A second trial involving the regime's four most senior surviving leaders is ongoing but the landmark proceedings risk being overshadowed by the controversy over the possible new cases.

These $$$$$$$$$ should be well spend on innocents khmer rather than this phony tribunal. In iraq it took only 3 months and cost nothing. The tribunal should be held outside Cambodia in the first place. ..eeyore!!

This ECCC will face a lot of obsticles from CPP, You Bouleang and Chea Leang and will end up with majority of Cambodian dissappointment.

I agree with Nuon Chea saying that the Communist Party of Kampuchea was under the influence of yuon Hanoi base on the profile and events happening since the creation of the Communist Party of Kampuchea or CPK in 1960 as follow:

CPK or the Communist Party of Kampuchea was created in 1960 under the name of the Workers' Party of Kampuchea to be remained alliance with Hanoi but not under order of Hanoi anymore by :

1. Tou Samouth.

2. Noun Chea.

3. Pol Pot.

4. Ieng Sary.

5. So Phim .

6. And many more of former senior Khmer Viet Minh commander.

Note: Tou Samouth and So Phim played very immportant role in joining former Khmer Viet Minh fighters int the CPK and other played an immportant rol in joining Tamouk and Ke Pok ect.... .

The worker's party was renaming to CPK in 1966 after Tou Samouth was arrested and killed in 1962.

So from the beginning most members and the members of central committee of CPK were former Khmer Viet Minh like Tou Samouth, So Phim , Rhos Nhim.

If ECCC is full of political interference, disband it, and move the whole trial to the International Criminal Court and International Court of Justice in The Hague to continue the trial further, so that true justice can be found for the Killing Filelds' victims.

The international communities should understand Vietnam's true intention of trying to mold Cambodia into a part of Vietnam.

To make this idea materialize, Vietnam must create trouble in Cambodia so that it could take advantage of the situation.

For instance, Vietnam created Khmer Vietminh and brainwashed them to kill Khmers during the Pol Pot's era.

Just curious:

Does international law allow one country to kidnap the children of its neighbors and brainwash them and later use them to attack their own Country and commit the mass killing of their own people?

Vietnam did exactly like that to Cambodia. That's why approximately 3 million Cambodians have perished from 1975 to 1979 because of Vietnam's bad intention toward Cambodia.

In addition, hundred of thousands of Khmer people dies in the 80s due to Vietnam’s deployment of the K5 project.

If the killings during the Pol Pot era’s were not clear that mostly were committed by the Khmer Vietminh, the K5 project on the other hand explicitly reflected Vietnam’s vicious intention toward Cambodia because Cambodia at the time was fully controlled by Vietnam, which was the chief architect of the K5 project.

The United Nations should look into this unique case of Vietnam’s interference in Cambodia. It should also examine at present Vietnam’s dominance in Cambodia too.

During my young life, I have heard my people lamented that why Khmer people always suffer?
Because Vietnam has its own plan of making Cambodian people suffer and exploit it. Vietnam has always found some dumb Khmers such as Hun Sen to carry out strictly its orders – no matter what the costs to Khmer people and Cambodia.

For instance, why did Hun Sen implement those bilateral treaties and defied the 1991 Paris peace accord?

6:44 PM I appreciate your knowledge of the people and tactics of Khmer Rouge. Please continue to share your knowledge with Khmer so we could all be educated about all the characters who are guilty of killing Khmer for almost 2 millions people between 1975 and 1979.
